Texas Increases Minimum Amount of Automobile Liability Insurance

Effective April 1, 2008, Texas drivers must carry minimum auto liability insurance of $25,000 for bodily injury for each injured person, up to a total of $50,000 per accident and $25,000 for property damage.

A Texas driver who causes a motor vehicle accident is responsible for paying for any damages he or she causes. Generally, a driver's automobile liability insurance will be used to compensate individual(s) who sustained medical expenses and/or property damage in the accident.

The minimum amount of liability insurance that drivers are required to have under Texas' financial responsibility law increased in 2008, due in part to concern that the old limits were not enough to cover costs related to serious injuries and property damage. The amount will increase again in 2011. Texas drivers must comply with the new minimums when renewing an automobile insurance policy or obtaining a new one on or after the effective dates of the increases.

Effective April 1, 2008, Texas drivers must carry minimum auto liability insurance of $25,000 for bodily injury for each injured person, up to a total of $50,000 per accident and $25,000 for property damage. This was an increase from the old minimum limits of $20,000 per injured person ($40,000 per accident) and $15,000 for property damage.

The minimum amounts of auto liability insurance will increase again on January 1, 2011, to $30,000 for bodily injury for each injured person, up to a total of $60,000 per accident and $25,000 for property damage.

Even though Texas law requires all drivers to carry the minimum amount of liability insurance, many drivers do not. In addition, even if a driver does carry the minimum amount, it may not be enough to cover the damages and expenses of a person who is seriously injured. In either of those situations, the injured party may need to pursue uninsured or underinsured motorist claims against his or her own insurance company.
